Assam FIR Row: Supreme Court Stays Pawan Khera’s Bail, Questions Telangana HC Order

In this passage, Khera was granted anticipatory bail that was to last to April 10, 2023 by Justice K. Sujana (Telangana High Court). The bail granted by the Telangana High Court will only be valid while Khera applies to the Gauhati High Court for further relief, and certain conditions are enforced on Khera while he holds anticipatory bail from the Telangana High Court.

There has been considerable media coverage concerning the Khera case as to whether Khera was being granted bail by the High Court of Assam after the Assam government’s request to stop the High Court from granting “limited transit anticipatory bail” under Article 21 of the Constitution was granted. Justice Maheshwari also expressed disbelief that Khera did not provide a reason as to why he could not go to Assam for a hearing. The Assam government also has challenged the bail decision as Khera did not provide an adequate reason as to why he did not file his bail motion in Assam when no legal proceedings had been initiated in Assam, indicating potential abuse of the court’s processes.

The First Information Report (FIR) against shri Khera contains charges for various crimes as outlined in the Bharat Nyaya Sanhita, including but not limited to: Making a false statement related to an Election, Cheating, Forgery, and Defamation. The Police of Assam previously attempted to contact shri Khera at Hyderabad and visited his home in New Delhi to speak with him.
