The Food Safety and Standards Authority of India (FSSAI) has initiated legal action against Nestlé India over alleged non-compliances involving its infant nutrition products NAN Excella Pro Stage 1 and Lactogen Pro 1. The regulator said it examined the products and their promotional material available on e-commerce platforms and flagged claims including “5 HMOs” and “Whey Protein” for NAN Excella Pro Stage 1 and a claim that whey protein was easy to digest for Lactogen Pro 1. According to FSSAI, the claims contravene provisions of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, which restrict promotional material intended to increase the saleability of infant foods. The regulator also cited restrictions under the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992. FSSAI said it sought clarifications from Nestlé India and has filed three separate adjudication cases related to the alleged violations. In a separate matter, laboratory analysis of a Nestlé follow-up formula sample found its biotin content non-compliant with prescribed requirements, a finding that was also confirmed by a referral laboratory. The latest action comes amid broader FSSAI enforcement against misleading advertising, labelling and other food safety violations. Nestlé India had also faced regulatory scrutiny earlier this year over allegations concerning Maggi noodles, which the company rejected, citing independent laboratory testing of a reference sample that found no infestation.
