The Delhi High Court has granted anticipatory bail to a man accused of sexually assaulting a minor, citing conflicting statements in the case and a lack of forensic evidence.
Justice Ravinder Dudeja, who presided over the case, noted that the 10-year-old girl had given inconsistent accounts of the alleged incident, which reportedly took place in September 2023. The court observed that forensic analysis of the girl’s samples did not yield any male DNA profile, further raising doubts about the allegations.
The accused, who was not initially named in the FIR, argued that the allegations were fabricated and influenced by external factors. Initially, the girl had accused her father of sexual assault, but later, her mother claimed that the real perpetrator was a barber from the neighborhood. The prosecution contended that the girl had been threatened into silence, which led to delays in reporting the incident.
While granting bail, the court directed the accused to furnish a personal bond and surety of ₹30,000 and prohibited him from contacting the victim or her family. The ruling has sparked discussions on the importance of forensic evidence and the challenges of handling sensitive cases involving minors.
